Agreement

By creating an account or using isthisthing.online (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

"You" refers to the individual or organization accessing the Service. "We", "us", and "our" refer to isthisthing.online.

1. Eligibility

You must be at least 16 years of age to use the Service. By using it, you represent that you meet this requirement.

2. Account Registration

  • You must provide accurate and complete information when registering.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately if you suspect unauthorized access to your account.
  • One person may not maintain more than one free account.

3. Acceptable Use

You agree not to:

  • Use the Service to monitor systems you do not own or have explicit permission to monitor
  • Send excessive automated requests that degrade Service performance for others
  • Attempt to gain unauthorized access to our infrastructure or other users' data
  • Use the Service to distribute malware, spam, or illegal content
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell or sublicense access to the Service without written permission

We reserve the right to suspend or terminate accounts that violate these rules without notice.

4. Plans, Billing & Payments

4.1 Free Plan

The Free plan is provided at no cost with the limits described on our Pricing page. We may change Free plan limits at any time with reasonable notice.

4.2 Paid Plans

Paid plans are billed monthly or annually via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.3 Refunds

We offer a 14-day refund on first-time paid subscriptions if the Service does not meet your needs. Subsequent renewals are non-refundable unless required by law.

4.4 Plan Changes

  • Upgrades take effect immediately and are prorated.
  • Downgrades take effect at the end of the current billing period.
  • Exceeding plan limits may result in reduced check frequency or temporary feature restrictions.

4.5 Taxes

Prices do not include applicable taxes (VAT, GST, etc.). You are responsible for any taxes applicable to your jurisdiction.

5. Service Level & Uptime

We aim for 99.9% platform uptime (excluding scheduled maintenance). This is a commercial commitment, not a legally binding SLA, unless separately agreed in writing.

Planned maintenance will be announced at least 24 hours in advance via our status page.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By accepting these Terms, you also accept our Privacy Policy.

7. Intellectual Property

  • The Service, including all software, designs, and documentation, is owned by isthisthing.online.
  • You retain full ownership of any data you submit to the Service (monitor configurations, status page content, etc.).
  • You grant us a limited license to store and process your data solely to provide the Service.

8. Confidentiality

We will treat your monitor configurations, check results, and workspace data as confidential and will not share them with third parties except as described in our Privacy Policy.

9. Third-Party Services

The Service integrates with third-party tools (Stripe, email providers, etc.). Your use of those integrations is subject to their own terms. We are not responsible for third-party service failures.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Results obtained from the Service will be accurate or reliable
  • The Service will meet your specific requirements

11. Limitation of Liability

To the maximum extent permitted by law, isthisthing.online shall not be liable for:

  • Loss of profits, revenue, or data
  • Indirect, incidental, or consequential damages
  • Damages resulting from service interruptions or monitoring failures

Our total aggregate liability shall not exceed the amount you paid us in the last 3 months.

12. Indemnification

You agree to indemnify and hold harmless isthisthing.online and its employees from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your misuse of the Service
  • Your violation of any third-party rights

13. Termination

By You

You may cancel your account at any time from your workspace billing settings. Upon cancellation, your data will be available for 30 days, after which it will be permanently deleted.

By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Fail to pay outstanding invoices after a 7-day grace period

We will provide advance notice where reasonably possible.

14. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law principles. Disputes shall be resolved in the courts of Istanbul, Turkey.

If you are a consumer in the EU, you may also have rights under the laws of your country of residence.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
